1. About KhmerRooms

KhmerRooms ("we," "us," or "our") is an online marketplace that connects travelers ("guests") with accommodation providers ("hotel owners") in Cambodia. By accessing or using www.khmerrooms.com, you agree to be bound by these Terms of Service.

These terms apply to all users of the platform, including guests, hotel owners, and visitors. If you do not agree, please do not use our platform.

2. Eligibility and Accounts

  • You must be at least 18 years old to create an account or make a booking
  • You must provide accurate and complete information when registering
  • You are responsible for maintaining the security of your account credentials
  • You are responsible for all activity that occurs under your account
  • You may not create multiple accounts or use another person's account without authorisation
  • We reserve the right to suspend or terminate accounts that violate these terms

3. For Guests

3.1 Bookings

When you submit a booking through KhmerRooms, you enter into a direct agreement with the hotel owner for the accommodation. KhmerRooms acts as a booking intermediary — we are not a party to the accommodation contract.

A booking is confirmed only after you receive a booking confirmation email and the hotel owner has accepted your reservation.

3.2 Cancellation and Refunds

Each hotel sets its own cancellation policy, which is displayed on the listing before you book. Please read the policy carefully before confirming. KhmerRooms does not override or modify individual hotel cancellation policies.

For non-refundable bookings, no refund is issued upon cancellation. For bookings with a flexible or moderate policy, refund eligibility depends on when the cancellation is made relative to check-in.

3.3 Payments

Payments are processed via KHQR through ABA PayWay. You must pay the full booking amount at the time of confirmation unless otherwise stated. All prices are displayed in US Dollars (USD).

3.4 Reviews

After your stay, you may submit a review. Reviews must be honest, based on your genuine experience, and comply with our community standards. We reserve the right to remove reviews that are fraudulent, abusive, discriminatory, or otherwise in violation of these standards.

You must not submit reviews for stays you did not personally complete, incentivise others to write reviews, or manipulate the review system in any way.

3.5 Disputes with Hotels

Disputes regarding the quality of accommodation, check-in issues, or damages must first be raised directly with the hotel. If unresolved, you may contact KhmerRooms support within 72 hours of check-out. We will assist in mediation but are not liable for outcomes.

4. For Hotel Owners

4.1 Listing Requirements

To list on KhmerRooms, your property must be a legitimate, legally operating accommodation in Cambodia. You must provide accurate descriptions, real photos, correct pricing, and up-to-date availability.

Listings must comply with all applicable Cambodian laws and regulations, including those governing tourism accommodation, fire safety, and health standards. KhmerRooms reserves the right to reject or remove any listing at its sole discretion.

4.2 Verification

All new hotel listings are subject to a verification process. You may be asked to provide identity documents, business registration, and property photographs. Listings go live only after approval by the KhmerRooms team.

4.3 Availability and Accuracy

You are solely responsible for keeping your availability calendar, pricing, and room information accurate and up to date. If a guest cannot check in because of an error in your listing (e.g., overbooking or incorrect information), you are responsible for arranging equivalent alternative accommodation at no extra cost to the guest.

4.4 Commission and Payouts

KhmerRooms charges a platform commission on each completed booking. The applicable commission rate is disclosed in your hotel owner agreement. Payouts are processed after guest check-in, minus the commission. KhmerRooms reserves the right to adjust commission rates with 30 days' notice.

In cases of guest cancellation within the refund window, no payout is made for the cancelled booking. For non-refundable bookings, payout proceeds as normal.

4.5 Guest Data

Guest contact information shared with you at booking (name, phone, email) must be used solely for managing the guest's stay. You may not add guests to marketing lists, sell their data, or contact them for purposes unrelated to their booking without their explicit consent.

4.6 Prohibited Listings

You may not list properties that:

  • You do not own or have the legal right to operate as accommodation
  • Do not exist or materially differ from their description
  • Are used for illegal activities
  • Discriminate against guests based on nationality, gender, religion, or other protected characteristics

5. Prohibited Conduct (All Users)

You may not:

  • Use the platform for any unlawful purpose
  • Attempt to gain unauthorised access to our systems or another user's account
  • Post false, misleading, or defamatory content
  • Harass, threaten, or abuse other users or KhmerRooms staff
  • Circumvent our booking or payment systems (e.g., arranging off-platform bookings to avoid commission)
  • Use automated tools, scrapers, or bots without our written permission
  • Impersonate another person or organisation

Violations may result in immediate account suspension, removal of listings, and, where applicable, legal action.

6. Intellectual Property

All content on KhmerRooms — including the logo, design, code, and platform text — is owned by or licensed to KhmerRooms. You may not reproduce, distribute, or create derivative works without our written consent.

By uploading photos or content to the platform (e.g., hotel photos, profile pictures), you grant KhmerRooms a non-exclusive, royalty-free licence to use that content for operating and promoting the platform.

7. Limitation of Liability

KhmerRooms provides the platform as-is and makes no warranties regarding the accuracy of listings, the quality of accommodation, or the conduct of hotel owners or guests.

To the fullest extent permitted by applicable law, KhmerRooms is not liable for:

  • Disputes between guests and hotel owners
  • Property damage, personal injury, or loss during a stay
  • Losses arising from inaccurate listing information
  • Service interruptions or platform downtime
  • Any indirect, incidental, or consequential damages

Our total liability in any matter arising from use of the platform is limited to the amount paid by you to KhmerRooms in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless KhmerRooms and its employees from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the platform, your violation of these terms, or your infringement of any third-party rights.

9. Governing Law

These Terms of Service are governed by the laws of the Kingdom of Cambodia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Phnom Penh, Cambodia.

10. Changes to These Terms

We may update these Terms of Service from time to time. Material changes will be notified via email or a prominent notice on the platform at least 14 days before they take effect. Your continued use of KhmerRooms after the effective date constitutes acceptance of the updated terms.
